As a grand narrative of progress, the utopian project of modernity is primarily concerned with notions of rationalism, universalism, and the development of a metalanguage. The triumph of the Moderate Enlightenment has seen logics of domination, accumulation and individualism incorporated into the project of modernity, with these logics giving rise to globalised capitalism as the metalanguage of modernity and neoliberal economics as the grand narrative of rational progress. The project of modernity is all but complete, requiring only the formality of (...) an end. However, rather than utopia, the foreseeable endpoint of modernity is environmental collapse, with neoliberal economics also serving as a grand narrative of environmental destruction. As an anti-modern response, postmodernism has been a triumphant failure. While there is much to be gained from the postmodern critique of modernity, its incredulity towards metanarratives has left it incapable of forming an adequate response to modernity, especially in regards to action on climate change. Postmodernism is better characterized as a crisis located within modernity itself and it will be argued that rather than the pursuit of the modern or the post-modern, we need to re-imagine ourselves as proto- historical to overcome the impasse of late-capitalism. What bearing did the works of Whitehead have on the late Merleau-Ponty and his emerging ontology of flesh? When gauged by analysis of citations alone, Whitehead’s influence on Merleau-Ponty appears to be a brief and minor encounter. However, despite the paucity of explicit reference to Whitehead, there is an argument to be made that Whitehead’s philosophy played a pivotal role in the development of Merleau-Ponty’s late thought. This can be understood in relation to Whitehead’s theory of education, which consists of (...) three stages: romance, precision, and generalization. It will also be shown how Whitehead’s theory of education corresponds to Merleau-Ponty’s incomplete phenomenological reduction. From this, we are provided with access to a metaphenomenological reading of Merleau-Ponty’s oeuvre, which can be understood as an ongoing movement between phenomenology and ontology, a movement in which Whitehead’s thought played a significant—if largely “invisible”—role. The ecological crisis demonstrates the inadequacy of current modes of thought to grasp the nature of reality and to act accordingly. A more sophisticated metaphysical system is necessary. Arran Gare, a prominent Australian philosopher, has produced such a system, which takes into account the post modern sciences of non-linear thermodynamics, quantum mechanics, and complexity theory. The present article promotes a cosmology based on Gare's metaphysics. In contrast to modern science, the postmodern account offered here will come to terms with a (...) world governed by indifference, which is the same indifference that Albert Camus describes as "absurd". Inspired by a (process) phenomenological reading of Deborah Bird Rose’s 1988 article “Exploring an Aboriginal Land Ethic,” and drawing on Merleau-Ponty’s claim that knowledge is “in the hands,” this paper explores the intersection of Merleau-Ponty’s embodied, process phenomenology and Indigenous Australian place-based ontologies. Rather than the moral demands or consequences of adopting an “Aboriginal land ethic,” the present paper is concerned with the ontological and epistemological – or, broadly speaking, the phenomenological – underpinnings of such a land ethic. Contra Rose’s (...) claim that, in the Western tradition, we “have very little idea of what a non-human-centred cosmos looks like and how it can be thought to work,” it is argued that Merleau-Ponty’s fundamental thought provides us with a viable pathway towards a non-human-centred phenomenological ontology that, somewhat paradoxically, is nevertheless grounded in the lived body. It is suggested that such an approach is compatible with, and complimentary to, the traditional Indigenous Australian ways of being and knowing outlined by Rose. (shrink)

Extracorporeal membrane oxygenation (ECMO) is typically viewed as a time-limited intervention—a bridge to recovery or transplant—not a destination therapy. However, some patients with decision-making capacity request continued ECMO support despite a poor prognosis for recovery and lack of viability as a transplant candidate. In response, critical care teams have asked for guidance regarding the ethical permissibility of unilateral withdrawal over the objections of a capacitated patient. In this article, we evaluate several ethical arguments that have been made in favor of (...) withdrawal, including distributive justice, quality of life, patients’ rights, professional integrity, and the Equivalence Thesis. We find that existing justifications for unilateral withdrawal of ECMO support in capacitated patients are problematic, which leads us to conclude that either: (1) additional ethical arguments are necessary to defend this approach or (2) the claim that it is not appropriate to use ECMO as a destination therapy should be questioned. The recent interest in wisdom in professional health care practice is explored in this article. Key features of wisdom are identified via consideration of certain classical, ancient and modern sources. Common themes are discussed in terms of their contribution to ‘clinical wisdom’ itself and this is reviewed against the nature of contemporary nursing education. The distinctive features of wisdom (recognition of contextual factors, the place of the person and timeliness) may enable their significance for practice to be promoted in more (...) coherent ways in nursing education. Wisdom as practical knowledge (phronesis) is offered as a complementary perspective within the educational preparation and practice of students of nursing. Certain limitations within contemporary UK nursing education are identified that may inhibit development of clinical wisdom. Mrs. Duong had coronary artery disease, ischemic cardiomyopathy, and mildly altered mental status when her case was presented before an advanced heart therapy medical review board. She was accepted for left ventricular assist device placement pending additional insight into her cognitive state. Before the LVAD could be implanted, however, Mrs. Duong went into cardiogenic shock, and her heart failure team placed an intra‐aortic balloon pump in her subclavian artery. Within two weeks, Mrs. Duong became IABP dependent and deconditioned. The attending (...) deemed her as lacking capacity to make complex medical decisions, and the medical review board officially declined her for LVAD placement. The heart failure and CICU teams feel that Mrs. Duong is not being helped by the care they are giving her. They recommend terminal weaning of the IABP and initiation of comfort care. Her family disagrees, pointing to activities like continued eating and interacting with family. At an impasse after yet another family meeting, the attending for the heart failure team asks the clinical ethics consultant, “Do we have to replace the balloon pump when it fails?”. (shrink)

Practice Theory and Education challenges how we think about practice, examining what it means across different fields and sites. This essay is an attempt to explain why Charles Sanders Peirce’s evolutionary metaphysics would not have seemed strange to its original 1890s audience. Building on the pioneering work of Andrew Reynolds, I will excavate the scientific context of Peirce’s Monist articles—in particular “The Law of Mind” and “Man’s Glassy Essence,” both published in 1892—focusing on the relationship between protoplasm, evolution, and consciousness. I argue that Peirce’s discussions should be understood in the context of contemporary evolutionary and physiological speculations, many (...) of which were featured in late- 1880s issues of Open Court, sister journal to the Monist. This article interrogates Andrew Feenberg’s thesis that modern technology is in need of ‘re-aestheticization’. The notion that modern technology requires aesthetic critique connects his political analysis of micro-contexts of social shaping to his wider concern with civilization change. The former involves a modified constructionism, in which the motives, values and beliefs of proximal agents are understood in terms of their wider sociological significance. This remedies a widely acknowledged blind-spot of conventional constructionism, enabling Feenberg to identify democratic potential in progressive (...) agency at the scene of technology design. Feenberg argues that the aesthetics of naturalistic modernism may serve as a bridge between such interventions and cultural transformation. Referring to developments in design culture, especially as this relates to the human-machine interface on digital artefacts, the article suggests that this part of Feenberg’s argument has been falsified. This kind of aesthetic modernism is hegemonic in contemporary design and it has not brought about significant progressive advance. In conclusion, the article suggests a different approach to aesthetic critique that is based on difference rather than wholeness, and on the principle that there is no inherent correspondence of aesthetic standards and ethics in technology design. Andrew Feenberg’s distinction between formal and substantive bias in the design of technology is interrogated. The two dimensions of his definition—inten­tion and the enhancement of specific social interests—are examined and eight logical possibilities arising from his argument are identified. These possibilities are explored through discussion of examples and it is argued that Feenberg has both: a) not broken sufficiently with substantivist philosophies of technology so that he retains ambivalence on technology’s ‘biased essence,’ and b) illegitimately rejected the idea of (...) a technology that is biased in itself. The latter category is important to critical theory of technology and the paper offers a conceptualization of it that draws on Habermas’s discourse ethics. (shrink)

Andrews and the Citizens' Committee Broke the Winnipeg General Strike by Tom Mitchell and Reinhold (...) Kramer. It identifies where the monographs depart from one another in interpretation; as well as where they remain the same. Given the layers of complexity, the interpretation of the event becomes especially salient in the 21st century as its 100th anniversary steadfastly approaches and the question of how should it be publicly presented in 2019 requires an answer soon. Hardcover $58.95.First, to address the exact nature of this volume: the bulk of A History of Early Vedānta Philosophy, Part Twoby Hajime Nakamura was part of Nakamura's (...) doctoral thesis submitted to Tokyo University in 1942, with, as the front flap states, "many additions and revisions done by the author himself." Part 1 was published by Motilal Banarsidass in 1976. For those interested, that first volume includes four parts: the chronology and significance of early Vedānta philosophy, early Vedānta philosophy as seen by other Indian (particularly Buddhist) thinkers and schools, scholars before the Brahmasūtra, and the nature and content of the Brahmasūtraitself. Part 2 is thus rather overdue, although various portions of this volume were published in the 1960s and 1970s. Hence, we should be grateful that the English-speaking world finally has more of the vast erudition of this titan of scholarship on Hindu thought, yet acknowledge that this is as much a pioneering historical document in Advaita research as a contribution to current knowledge.Despite this reservation, let us begin with fulsome praise: how many scholars in any discipline from any period can rival Hajime Nakamura? Even in his dissertation, he shows wide familiarity with Hindu and Buddhist thought, having consulted sources in Sanskrit, Pāli, Prakrit, Tibetan, Chinese, Japanese, English, German, and probably others. Who, ever again, would have the courage, or the linguistic skills, to attempt a book called Ways of Thinking of Eastern Peoples?Truly this was a jñānasāgara!Still, one must say that the present volume has shortcomings beyond age: it is not particularly well-organized or "user-friendly," not always well-focused, and sometimes repetitious. The translations, while clear, are generally not graceful. And in the decades since the bulk of this was written, much additional scholarship on key figures and texts discussed therein has been published, and new theoretical conceptualizations have arisen to aid our understandings. Depending on one's view, this text reveals the notable absence of (or freedom from) contemporary scholarly currents of postcolonial, postmodern, or feminist critique, nor does it reflect the move to greater social history often apparent today. It is also surprisingly noncomparative, given the author's later work. This, then, is mostly a traditional history of the development of ideas by one of the pitāmahasof classical Indian scholarship.The book is divided into four basic sections. First are remarks on the life, works, and ideas of post- Brahmasūtrabut pre-Śaṅkara thinkers such as Upavarṣa, Bodhāyana (who influenced Rāmānuja), and Bhartṛprapañca (whom Śaṅkara and Sureśvara opposed, particularly on jñānakarma-samuccaya), with frequent comparisons of their thinking with that of Śaṅkara. This section well traces the basic time and lineage of key thinkers, and nicely unpacks their views and later influence. Nakamura describes and offers extensive analysis of each chapter (prakaraṇa)and its characteristics separately, particularly the thought (on consciousness states, māyā, ajātivāda, and Buddhist ideas, respectively) and practices ( ommeditation, Self-realization, asparśayoga, etc.) distinctive to each. He clearly shows the differences in doctrine and application among the chapters, and between them and the Māndūkya Upaniṣad. Nakamura raises the questions of the text's authorship, sacrality, unity, and extent of Buddhist influence, which had already been debated by many scholars at that time, and yet this section shows its age; while even-handedly summarizing the discussion to that point, and offering his own judiciously reasoned conclusions (most importantly, that they are four independently composed treatises), his conclusions are neither groundbreaking nor today near to the last word. Significant challenges arise for clinical care teams when a patient or surrogate decision-maker hopes a miracle will occur. This article answers the question, “How should clinical bioethicists respond when a medical decision-maker uses the hope for a miracle to orient her medical decisions?” We argue the ethicist must first understand the complexity of the miracle-invocation. To this end, we provide a taxonomy of miracle-invocations that assist the ethicist in analyzing the invocator's conceptions of God, community, and self. After the ethicist (...) appreciates how these concepts influence the invocator's worldview, she can begin responding to this hope with specific practices. In this paper we aim to show that phenomenal consciousness is realized by a particular level of brain operational organization and that understanding human consciousness requires a description of the laws of the immediately underlying neural collective phenomena, the nested hierarchy of electromagnetic fields of brain activity – operational architectonics. We argue that the subjective mental reality and the objective neurobiological reality, although seemingly worlds apart, are intimately connected along a unified metastable continuum and are both guided by the universal (...) laws of the physical world such as criticality, self-organization and emergence. This study examines the use of a modified form of the theory of planned behavior in understanding the decisions of undergraduate students in engineering and humanities to engage in cheating. We surveyed 527 randomly selected students from three academic institutions. Results supported the use of the model in predicting ethical decision-making regarding cheating. In particular, the model demonstrated how certain variables (gender, discipline, high school cheating, education level, international student status, participation in Greek organizations or other clubs) and moral constructs (...) related to intention to cheat, attitudes toward cheating, perceptions of norms with respect to cheating, and ultimately cheating behaviors. Further the relative importance of the theory of planned behavior constructs was consistent regardless of context, whereas the contributions of variables included in the study that were outside the theory varied by context. Of particular note were findings suggesting that the extent of cheating in high school was a strong predictor of cheating in college and that engineering students reported cheating more frequently than students in the humanities, even when controlling for the number of opportunities to do so. How should clinical ethicists be trained? Scholars have stated that clinical ethics fellowships create well-trained, competent ethicists. While this appears intuitive, few features of fellowship programs have been publicly discussed, let alone debated. In this paper, we examine how fellowships can foster effective mentoring relationships. These relationships provide the foundation for the fellow’s transition from novice to competent professional. In this essay, we begin by discussing our pedagogical commitments. Next, we describe the structures our program has created to assist our (...) fellows in becoming competent ethicists. We then outline the kinds of knowledge, skills, and professional attributes mentors should possess. Following this, we focus on the knowledge, skills, and professional attributes that fellows develop as they co-create effective mentoring relationships. We will not prescribe a single approach to fellowship training; instead, our perspective will, we hope, become a catalyst for further conversation on training and mentoring clinical ethics fellows. Determining whether a homoplastic trait is the result of convergence or parallelism is central to many of the most important contemporary discussions in biology and philosophy: the relation between evolution and development, the importance of constraints on variation, and the role of contingency in evolution. In this article, I show that two recent attempts to draw a black-or-white distinction between convergence and parallelism fail, albeit for different reasons. Nevertheless, I argue that we should not be afraid of gray areas: a (...) clarified version of S. J. Readers have much to consider when evaluating Greenblum and Hubbard’s conclusion that ‘physicians have no business doing theology’.1 The two central arguments the authors offer are fairly convincing within the confines they set for themselves, the provisos they stipulate and their notions of ‘privacy’ and ‘public reason’. However, I would ask readers to consider two questions, the answers to which I believe the authors leave opaque. First, what is theological negotiation? Second, what makes chaplains the singular group of healthcare professionals (...) responsible for theological negotiation? In this Commentary, I explore these questions not with the goal of rejecting the authors’ conclusion, but rather with the goal of highlighting relevant considerations when evaluating the authors’ central tenets. First, I would like readers to consider Greenblum and Hubbard’s descriptions of theological negotiation. They categorise theological negotiation into metaphysical, normative and alternative responses, and hold that this kind of negotiation is, for the most part, impermissible for healthcare professionals, save chaplains.1 The examples of Dr Chatterjee and Dr Thompson expand theological negotiation to include instances where physicians add a theological veneer to their clinical recommendations. The therapeutic potential of meditation for physical and mental well-being is well documented, however the possibility of adverse effects warrants further discussion of the suitability of any particular meditation practice for every given participant. This concern highlights the need for a personalized approach in the meditation practice adjusted for a concrete individual. This can be done by using an objective screening procedure that detects the weak and strong cognitive skills in brain function, thus helping design a tailored meditation training protocol. (...) Quantitative electroencephalogram (qEEG) is a suitable tool that allows identification of individual neurophysiological types. Using qEEG screening can aid developing a meditation training program that maximizes results and minimizes risk of potential negative effects. This brief theoretical–conceptual review provides a discussion of the problem and presents some illustrative results on the usage of qEEG screening for the guidance of mediation personalization. Decoherence results from the dissipative interaction between a quantum system and its environment. As the system and environment become entangled, the reduced density operator describing the system "decoheres" into a mixture (with the interference terms damped out). This formal result prompts some to exclaim that the measurement problem is solved. I will scrutinize this claim by examining how modal and relative-state interpretations can use decoherence. Although decoherence cannot rescue these interpretations from general metaphysical difficulties, decoherence may help these interpretations to (...) pick out a preferred basis. I will explore whether decoherence solves nagging technical problems associated with selecting a preferred basis. (shrink)

This essay considers the growing interest in the methodology of jurisprudence in the context of a broader examination of the relationship between legal theory and the practice of law. Attention is drawn to the particular puzzles of how theory can both be independent of and yet inform practice, and how methodology can take a similar stance towards theory. Through a detailed analysis of the methodological positions adopted by Dworkin, Raz, and Coleman and Simchen, the conclusion is reached that methodology is (...) not a resource capable of offering an independent assessment of the merits of competing theories.Mainstream jurisprudential discussion is traced through the Hart-Dworkin debate to assumptions on the relationship between theory and practice initially adopted by Hart and sustained by subsequent contributors. The morbid condition of a prominent part of contemporary jurisprudence is identified with an unwarranted elevation of theory over practice. A more fruitful role for theory is suggested, in expounding the controversies met in the practice of law and considering the potential that exists for resolving them. It is suggested that this approach breaks down an artificial divide between descriptive and normative jurisprudence.A number of ancillary matters are discussed in the essay including: semantic approaches to legal theory, Dworkin’s semantic sting, the distinction between methodological and theoretical elements of Law’s Empire, Dickson on the ‘indirectly evaluative approach’, the position of Hart in his Postscript, and Raz’s split theory of legal reasoning and law. If good argument is virtuous, then fallacies are vicious. Yet fallacies cannot just be identified with vices, since vices are dispositional properties of agents whereas fallacies are types of argument. Rather, if the normativity of good argumentation is explicable in terms of virtues, we should expect the wrongness of fallacies to be explicable in terms of vices. This approach is defended through case studies of several fallacies, with particular emphasis on the ad hominem.

Applying basic concepts of Logic-Based Therapy (LBT), this paper addresses the author’s own struggle with demanding perfection, and seeks to provide a model for others to emulate.

In this paper, I draw a parallel between Søren Kierkegaard’s pseudonym Johannes Climacus and Jean-Luc Marion’s phenomenological account of revelation. By connecting Climacus’ notion of the paradox with Marion’s saturated phenomenon, I both defend what I see as similar in the two accounts and attack the clarity of Marion’s notion of saturated phenomenon. I first explicate Marion’s accusation of subject-centeredness against Husserl’s Cartesians Meditations which the transcendental ego receives from Descartes and Kant. I then look at how Marion uses this (...) to motivate his concept of the saturated phenomenon. Finally, I argue that Climacus’s paradox accomplishes the same in a more philosophical way. (shrink)
